DMCA Policy

MovieCellar ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to notices of alleged copyright infringement that comply with the DMCA and are properly submitted to our designated agent.

Reporting Copyright Infringement

If you believe that content on MovieCellar infringes your copyright, please submit a written notification to our designated DMCA agent containing the following information:

  1. Identification of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the material that you claim is infringing and that you request be removed or access to which be disabled, with enough information for us to locate the material (e.g., a URL or description).
  3. Your contact information, including your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature (typing your full legal name is sufficient for an electronic signature).

Counter-Notification

If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us containing the following information:

  1. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  2. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which MovieCellar may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.
  4. Your physical or electronic signature.

Processing

Upon receiving a valid DMCA takedown notice, we will:

  • Remove or disable access to the allegedly infringing material promptly
  • Notify the user who posted the material that it has been removed
  • Provide the user with a copy of the takedown notice and information about filing a counter-notification

Upon receiving a valid counter-notification, we will:

  • Forward the counter-notification to the original complainant
  • Inform the complainant that the removed material will be restored in 10 business days unless the complainant files a court action
  • Restore the material within 10 to 14 business days after receiving the counter-notification, unless we receive notice that the complainant has filed a court action

Repeat Infringers

MovieCellar will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. A repeat infringer is a user who has been the subject of more than one valid DMCA takedown notice.

Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
