Terms of Service

Welcome to MovieCellar. These Terms of Service ("Terms") govern your use of the MovieCellar website (moviecellar.app) and mobile application (collectively, the "Service"), operated by MovieCellar ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use MovieCellar. By using the Service, you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to keep it up to date. You must notify us immediately at support@moviecellar.app if you become aware of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, remain inactive for an extended period, or are used in a manner that threatens the security or integrity of the Service.

3. Your Movie Collection Data

Ownership

You retain full ownership of your movie collection data, including the titles, purchase information, ratings, reviews, lists, and any other content you create within the Service ("User Content"). MovieCellar does not claim any ownership rights over your User Content.

License

By submitting User Content to the Service, you grant MovieCellar a limited, non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content solely for the purpose of operating and providing the Service. For example, if you make your collection public, we need this license to display it to other users. This license terminates when you delete your User Content or your account.

Data Export

You may export your movie collection data at any time through your account settings. We support export in standard formats (CSV, JSON) to ensure you can take your data with you.

4. AI-Powered Features

MovieCellar uses artificial intelligence technology to identify movies from poster images you upload or scan.

  • Image Processing. When you use the poster identification feature, your image is sent to our AI vision service for processing. The image is analyzed in real time to identify the movie and is not stored after identification is complete.
  • No Training. Your uploaded images are not used to train AI models.
  • Accuracy. AI-powered identification may not always be accurate. Results are provided for convenience and should be verified by you. MovieCellar is not responsible for incorrect identifications.
  • Consent. You will be asked for consent before using AI-powered features for the first time. You may decline to use these features without losing access to core Service functionality (manual movie search and add remains available).

5. Movie Metadata and Posters

MovieCellar uses data from The Movie Database (TMDb) for movie metadata, including titles, synopses, cast, crew, and poster images. This product uses the TMDb API but is not endorsed or certified by TMDb. Movie poster images displayed in the Service are the property of their respective copyright holders and are displayed for informational and organizational purposes.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or use automated means to access the Service without our written permission
  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate another person or entity
  • Use the Service to distribute spam, malware, or other harmful content
  • Circumvent or attempt to circumvent any security measures or access controls
  • Resell, redistribute, or sublicense access to the Service
  • Use the Service in any manner that could damage, disable, or impair the Service

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including removing content, suspending accounts, and reporting to law enforcement.

7. Social Features and Community Guidelines

MovieCellar includes social features such as public profiles, following other users, activity feeds, reviews, ratings, and lists. When using social features:

  • Be respectful of other users
  • Do not post spoilers without appropriate warnings
  • Do not harass, bully, or target other users
  • Do not post content that is illegal, hateful, discriminatory, or sexually explicit
  • Do not use social features for advertising or commercial solicitation

Users may report inappropriate content or behavior. We will review reports and take action as we deem appropriate, which may include content removal, warnings, or account suspension.

8. Intellectual Property

The Service, including its design, code, features, and branding (excluding User Content and third-party content such as movie metadata), is owned by MovieCellar and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

9. DMCA and Copyright

We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, please submit a notice to our designated DMCA agent at dmca@moviecellar.app. For details, see our DMCA Policy.

We will respond to valid takedown notices and may remove infringing content. Repeat infringers may have their accounts terminated.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

AI-POWERED FEATURES, INCLUDING MOVIE IDENTIFICATION, ARE PROVIDED FOR CONVENIENCE ONLY AND MAY PRODUCE INACCURATE RESULTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OF AI-GENERATED RESULTS.

MOVIE PRICING INFORMATION, IF AND WHEN AVAILABLE, IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY NOT REFLECT CURRENT PRICES. WE ARE NOT RESPONSIBLE FOR PRICING DISCREPANCIES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOVIECELLAR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. IN PARTICULAR, NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS AS A CONSUMER UNDER THE LAWS OF YOUR JURISDICTION, INCLUDING IN THE EUROPEAN UNION AND UNITED KINGDOM.

12. Indemnification

You agree to indemnify and hold harmless MovieCellar and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

13. Dispute Resolution

Informal Resolution

Before filing any formal legal proceedings, you agree to first contact us at support@moviecellar.app and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws principles.

Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Atlanta, Georgia, or at another mutually agreed location.

Class Action Waiver

YOU AND MOVIECELLAR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Small Claims Exception

Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

Consumer Protection

Nothing in this section limits your rights under applicable consumer protection laws, including your right to bring proceedings in the courts of your habitual residence if you are a consumer in the European Union or United Kingdom.

14. Account Deletion

You may delete your account at any time through your account settings or by contacting support@moviecellar.app. Upon deletion:

  • Your account information will be removed from our active systems within 30 days
  • Your User Content (reviews, ratings, lists) will be deleted
  • Your movie collection data will be deleted
  • You will have the opportunity to export your data before deletion
  • Certain information may be retained as required by law (e.g., for tax or legal compliance) or in backups for up to 90 days

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and, where practicable, by email. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

16. General Provisions

  • Entire Agreement. These Terms, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and MovieCellar regarding the Service.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
